Reading Art Essay

The four main roles of an artist according to Henry M. Sayre are: Keeping a historical record much of the art that was created in the past and that is considered to be history was created at a time when most of the people in the world were considered to be illiterate, and it was better for the people to get a visual understanding because it was better for them to understand than a worded understanding. Another role is to be able to give form to intangibles when one thinks of the emotions of fear, love, or even adornment these emotions cannot be seen but are felt, an artist’s job is to create works that can make these feelings seen in their work. The next main role of an artist is being able to reveal the hidden, when an artist creates a piece through their own interpretation instead the actual event. Picasso was known for this type of works. The last main role of an artist is showing the world a new way when one is an artist they may see the same exact things as everyone else does, but when it come to them interpreting things the artists inspiration is beyond any other humans. When one is able to see the world through the eyes of any artist, they will be able to see it in a whole new way (Xaxx, 1999-2011). An example of a piece of art that is an explanation of symbolic significance would be Pablo Picasso’s â€Å"Guernica† this piece may not be a picture of the actual events of what happened at the Massacre of Guernica but this is how he portrayed them, or how the artist saw the victims of that massacre. Another example of a piece of art is Sara Atzmon’s â€Å"A Sealed Room at the Center of the World†. Atzmon was a Holocaust survivor who had seen many of her family members murdered during the Holocaust many of her pieces reflect the pain and horror that she saw during these events (Pelaia, 2011). The bank insists the lessee to pay an amount monthly for the use of the asset. The rights of the asset remains with the bank, and only the privileges of use are transferred to the lessee. 2. Types of Ijarah Contracts Used By Islamic Financial Institutions: 2.1 Simple Ijarah (similar to an Operating Lease) In a business world marred by financial uncertainties and increasing costs of operations, Ijarah loans are broadly considered as the safest, easiest, and the most efficient means to finance production procedures. Like all the other forms of Islamic financing, Ijarah too is rooted in the sound economic main attitude laid down by the Sharia. There are different types of Ijarah, each matched to the specific needs of the parties involved in the agreement. â€Å"The two most popular forms of Ijarah loans are the Simple Ijarah or Ijarah as an operating lease and Ijarah thumma al-bai or Ijarah as a financial lease. The distinguishing feature of Ijarah as an operating lease is that the lease contract is not associated with a purchase agreement.† (All About Ijara as an Operating Lease 2005). The following are some of the features of Ijarah as an operating lease: The whole price of the asset, or the part of property specified in the contract is not amortized through the main leasing tenure. The lessee can get out of the contract, that is, stop the Ijarah as an operating lease agreement anytime the lessee wishes to. On the other hand, the lessee should provide a notice prior to doing so. The real ownership of the piece of property or assets mentioned in the agreement is retained by the lessor. This agreement is executed irrespective of the quantity of payment the lessee has tendered, and that identifies the lessor’s insistence to bear every responsibility and risk connected with the ownership. In Ijarah as an operating lease, permits a part of the property to be returned to the lessor at the end of the leasing tenure. The lessor, which can be a bank or any other financial organization, can again lease the property, if i t is a functioning unit, to a different person or business unit. 2.2 Ijarah Muntahia Bittamleek (similar to a Financing Lease) Ijarah Muntahia Bittamleek is an Ijarah dealing, in which the possession of the subject asset can be relocated to the lessee after the lease term. Ijarah and Ijarah Muntahia Bittamleek are by nature mere leasing contracts, in which the subject issue is the usufruct of the property; and not the quantity of cash, as in the case of a finance lease. International commercial arbitration is a way in which parties can use an alternative method of dispute resolution on an international level. International law however does not clearly and concisely define what it is in reality. Alternatively, the UNCITRAL contains a Model Law which governs and defines more clearly international commercial arbitration as â€Å"any arbitration whether or not administered by a permanent arbitral institution†.1 David also provides a definition which states that ICA is a tool by which parties can settle a question by decisions of third parties â€Å"who derive their powers from a private agreement, not from the authorities of a State, and who are to decide the case on the basis of such an agreement†.2 Indeed, arbitration clauses are often specifically contained in contracts, which are specified as binding on the parties outside of court: ICA is binding privately according to the agreement of the parties.3 The purpose of the UNCITRAL Model Law is to aid states in reforming and brining up to date their national laws and regulations on the process of arbitration and it was adopted and implemented globally some 26 years ago.4 The Model Law is comprehensive and applies to all signatory states in many areas of ICA, including the recognition and enforcement of orders and awards, though states are not obliged to directly apply the law in their domain. Such countries prefer to use the Model Law as a framework which they adapt to coincide with their own national laws, economic systems, and public policy norms. Privity of Contract in International Commercial Arbitration Privity of contract requires that all parties to an agreement must voluntarily commit to the agreement for it to be enforceable; this is otherwise termed as mutual consent. In an ICA context, it can thus be applied to state that the parties to a contractual arbitration clause must voluntarily agree to the content of t he clause before it can be deemed binding upon the parties. Essentially, it is stated that arbitration without privity is not enforceable; particularly if â€Å"coercion, fraud,...[and]... lack of identity of the parties† is evident.5 Privity of contract thus aims to provide an equal playing field for both parties who come from different counties, as it allows them to rely on arbitration clauses in order â€Å"to be free of national procedural and substantive law†.6 ICA thus allows disputes which may arise between parties to become subject to regulations which are on a different level to the national laws of the parties so that claims concerning international privity of contract may be avoided. By agreeing on an alternative method of arbitration, both parties are able to be defined as autonomously agreeing to settle their disputes in a value-free manner. However, this again is differently viewed in practice, as many express concern in relation to privity of contract be cause parties to a contract may not be said to be parties to the international regulations on ICA.
